1. Acceptance of Terms
These Terms of Service ("Terms") are a legally binding agreement between you and PamirAI Inc. ("PamirAI," "Pamir," "we," "us," or "our"). These Terms govern your access to and use of our websites, hardware products, device software, cloud services, APIs, remote access infrastructure, mobile applications, documentation, support, and related services (collectively, the "Services").
By purchasing a PamirAI hardware product, creating an account, accessing or using the Services, or using our website, you agree to these Terms. If you do not agree, do not purchase, access, or use our products or Services.
2. Products and Services
PamirAI provides hardware devices, including the Distiller device, Clawdbot editions, and other PamirAI hardware products (each, a "Device"), together with related software and cloud connectivity services.
Our products and Services may include:
- Hardware devices designed to run software, automation, and AI agent workflows.
- Device software, firmware, and operating-system components provided with or for a Device.
- Cloud services for account management, device registration, pairing, remote access connectivity, push notifications, temporary file transfer, and service administration.
- Mobile or client applications used to access and manage a Device.
- Websites, documentation, support channels, waitlists, and checkout flows.
PamirAI is a hardware and platform provider. We do not provide, develop, operate, or control the third-party AI models or AI services that you may choose to use on a Device. You access those AI services independently using your own credentials and under your own relationship with the applicable provider.
3. Eligibility and Accounts
You must be at least 18 years old to create an account, purchase a Device, or use the Services. By using the Services, you represent that you are at least 18 and have authority to agree to these Terms.
When creating or using an account, you agree to:
- Provide accurate, current, and complete information.
- Keep your account information accurate and current.
- Maintain the confidentiality and security of your account credentials.
- Accept responsibility for all activity under your account.
- Notify us promptly of unauthorized access or suspected compromise.
We may suspend or terminate accounts that contain inaccurate information, are used in violation of these Terms, or present a security, legal, or operational risk.
4. Purchases, Shipping, Returns, and Hardware Support
Prices, availability, configurations, shipping options, taxes, and delivery estimates may change. Orders may be processed through Shopify or another third-party checkout provider. Additional checkout terms, payment terms, shipping terms, or product-specific notices shown during checkout or on a product page also apply.
Delivery dates and lead times are estimates, not guarantees. Title and risk of loss for a Device pass to you when the Device is delivered to the shipping address, except where applicable law provides otherwise.
Unless a product page, checkout flow, or written policy says otherwise, hardware purchases are final once shipped. If an order has not shipped, you may request cancellation, but cancellation is not guaranteed.
If a Device arrives materially damaged, defective on arrival, or materially different from what you ordered, contact founders@pamir.ai within 7 days of delivery with your order number and supporting details. We may, at our discretion and as required by applicable law, offer troubleshooting, repair, replacement, or refund.
Alpha, beta, prototype, developer, pre-release, or limited-batch Devices may be experimental and may not have the same reliability, polish, compatibility, or support lifecycle as production consumer electronics. Except as expressly stated in a product-specific written warranty, checkout notice, or applicable law, Devices and Services are provided without a separate hardware warranty. Nothing in these Terms limits any non-waivable rights you may have under applicable consumer protection or warranty laws.
5. Device Software License
The physical Device you purchase is sold to you, but the software, firmware, operating-system image, applications, and related code provided by PamirAI for use on or with the Device ("Device Software") are licensed, not sold.
Subject to your compliance with these Terms, PamirAI grants you a limited, non-exclusive, non-transferable, revocable license to use the Device Software only on the Device or with the Services for your personal or internal business purposes.
You may not:
- Copy, modify, distribute, sell, sublicense, or lease the Device Software except as expressly permitted by PamirAI or applicable open-source licenses.
- Reverse engineer, decompile, or disassemble the Device Software except where applicable law permits this despite a contractual restriction.
- Remove, alter, or obscure proprietary notices.
- Use the Device Software separately from the Device or Services for which it was provided.
- Circumvent license, security, or access-control mechanisms.
Some Device Software may include open-source components. Open-source components are licensed under their applicable open-source licenses, and those licenses control where they conflict with these Terms.
6. Acceptable Use
You may use the Device and Services only for lawful purposes and in accordance with these Terms. You must not use the Device or Services to:
- Violate any applicable law or regulation.
- Infringe, misappropriate, or violate intellectual property, privacy, publicity, or other rights.
- Gain unauthorized access to systems, accounts, networks, devices, or data.
- Create, deploy, or distribute malware, ransomware, botnets, credential theft tooling, or other malicious software.
- Interfere with, disrupt, overload, scan, probe, or compromise PamirAI infrastructure or another user's systems.
- Bypass security controls, access restrictions, rate limits, or authentication systems.
- Develop, design, produce, or facilitate weapons, explosives, dangerous materials, or instructions for harmful misuse.
- Compromise or interfere with critical infrastructure, including power, water, transportation, communications, medical, emergency, or public safety systems.
- Engage in fraud, phishing, deception, spam, harassment, abuse, doxing, stalking, or predatory behavior.
- Generate, process, or distribute unlawful, exploitative, or abusive content.
- Use the Services in a way that creates legal, security, privacy, safety, or operational risk for PamirAI, other users, or third parties.
7. Third-Party AI Provider Compliance
The Device may be used with third-party AI providers such as Anthropic, OpenAI, or other services you choose. Your use of those providers is governed by their terms, policies, and acceptable-use rules. PamirAI is not a party to your relationship with those providers.
You are solely responsible for:
- Obtaining and maintaining your own provider credentials.
- Reviewing and complying with provider terms and usage policies.
- Monitoring AI agents and outputs that run on your Device.
- Ensuring that your use of AI services through the Device is lawful and permitted by the applicable provider.
When using AI services through a Device, you must not:
- Circumvent, bypass, jailbreak, or attempt to override AI provider safety systems, restrictions, or content filters.
- Use AI services to generate or facilitate content or conduct prohibited by the applicable provider.
- Use AI agents to compromise systems, networks, privacy, or security.
- Use automated methods to abuse, overload, scrape, or interfere with an AI provider's services.
- Use AI model inputs or outputs to train another model where the provider prohibits that use.
- Deploy AI agents in high-risk contexts, including legal, healthcare, financial, employment, housing, education, insurance, essential services, public safety, or similar decisions, without appropriate human oversight and required disclosures.
- Present AI-generated interactions to consumers or end users as human where disclosure is required by law or provider policy.
Provider policies may change. For reference, Anthropic's Usage Policy is available at https://www.anthropic.com/legal/aup and OpenAI's Usage Policies are available at https://openai.com/policies/usage-policies. You are responsible for reviewing the current policies that apply to your use.
If your use of a Device causes a third-party AI provider to suspend or terminate your access, PamirAI is not responsible for restoring that access. Loss of access to a third-party AI service does not entitle you to a refund for a Device or Services. If PamirAI becomes aware that you are using the Services in a way that materially violates these Terms or creates risk to PamirAI or others, we may suspend or terminate your access to cloud Services.
8. Your Content and Data
As between you and PamirAI, data stored locally on your Device, including AI credentials, prompts, agent sessions, outputs, project files, terminal history, and network credentials, remains under your control. You are responsible for backing up, protecting, deleting, and securing data stored on your Device.
PamirAI does not collect or store your local AI provider credentials, chat histories, agent sessions, terminal history, source code, or project files on PamirAI cloud servers, except where you intentionally use a cloud feature that transfers or stores data temporarily.
To provide cloud Services, PamirAI stores certain account, device, connection, push-notification, usage, waitlist, order, and support information as described in our Privacy Policy at https://www.pamir.ai/privacy.
Remote communications between a supported client application and Device are designed to be end-to-end encrypted using ECDH-P256 key exchange with AES-256-GCM encryption. When encrypted traffic is relayed through PamirAI infrastructure, PamirAI cannot read the contents of that encrypted communication, but may process connection metadata needed to establish, maintain, troubleshoot, secure, and improve the connection.
9. Device Security
You are responsible for maintaining the physical and logical security of your Device and credentials. This includes:
- Changing default credentials when prompted or when instructed by PamirAI.
- Using strong passwords and protecting SSH, Wi-Fi, API, OAuth, and other credentials.
- Securing your home, office, or lab network.
- Keeping Device Software, firmware, and dependencies reasonably up to date.
- Reviewing and monitoring AI agent behavior before relying on outputs or allowing actions.
- Not sharing device access credentials with unauthorized people.
- Removing credentials and resetting the Device before resale, transfer, disposal, or return.
PamirAI is not responsible for unauthorized access, data loss, AI agent behavior, or third-party misuse caused by your failure to secure your Device, credentials, network, or third-party accounts.
10. Intellectual Property and Feedback
PamirAI and its licensors retain all rights, title, and interest in the Services, Device Software, websites, documentation, trademarks, logos, branding, designs, and related intellectual property. These Terms do not grant you the right to use PamirAI trademarks, logos, or branding without prior written permission.
If you provide feedback, ideas, suggestions, bug reports, or improvement requests, you grant PamirAI a worldwide, perpetual, irrevocable, royalty-free license to use them without restriction or compensation to you.
11. Third-Party Services and Links
The Device and Services may interoperate with third-party services, software, websites, APIs, AI providers, open-source packages, checkout providers, scheduling providers, and integrations. Third-party services are governed by their own terms and policies.
PamirAI does not control and is not responsible for third-party services, including their availability, security, accuracy, reliability, outputs, policies, or business practices. Issues with third-party services should be directed to the applicable third party.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVICES AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WITHOUT LIMITING THE FOREGOING, PAMIRAI DOES NOT WARRANT THAT:
- A Device or Service will meet your requirements or expectations.
- A Device or Service will be uninterrupted, timely, secure, compatible, accurate, complete, or error-free.
- AI agents, third-party models, or third-party services will produce accurate, safe, lawful, complete, reliable, or appropriate outputs.
- Defects, vulnerabilities, compatibility issues, or software errors will be corrected.
- A Device will remain compatible with all third-party providers, networks, hardware, software, or APIs.
AI agent technology can be unpredictable. Outputs may be inaccurate, incomplete, unsafe, biased, or inappropriate. You are solely responsible for reviewing, validating, supervising, and deciding whether to rely on any output or action.
Nothing in these Terms excludes, restricts, or modifies any warranty, consumer right, or legal protection that cannot be excluded, restricted, or modified under applicable law.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAMIRAI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, GOODWILL, DATA, USE, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:
- Your use of or inability to use a Device or Service.
- AI agent outputs, actions, omissions, or decisions.
- Third-party AI providers, APIs, software, services, or policies.
- Unauthorized access to or alteration of your data, Device, credentials, accounts, or transmissions.
- Loss, corruption, deletion, exposure, or damage to data stored on a Device.
- Interruption, suspension, or termination of third-party AI services or PamirAI cloud Services.
- Security incidents, network conditions, compatibility issues, bugs, or service interruptions.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAMIRAI'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, A DEVICE, OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO PAMIRAI FOR THE DEVICE OR SERVICE GIVING RISE TO THE CLAIM.
The limitations above apply even if a remedy fails of its essential purpose and even if PamirAI has been advised of the possibility of damages, except where prohibited by law.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless PamirAI and its officers, directors, employees, agents, affiliates, suppliers, and licensors from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:
- Your use or misuse of a Device or Service.
- Your violation of these Terms.
- Your violation of third-party AI provider terms or policies.
- Content, data, prompts, outputs, files, code, commands, or actions generated, processed, stored, transmitted, or executed through your Device or account.
- Your violation of law or third-party rights.
- Your failure to secure your Device, account, credentials, network, or third-party accounts.
15. Suspension and Termination
We may suspend or terminate your access to cloud Services at any time if we reasonably believe that:
- You violated these Terms.
- Your use creates legal, security, privacy, safety, or operational risk.
- Your account or Device appears compromised.
- You are using the Services for fraud, abuse, illegal activity, or harmful conduct.
- Suspension or termination is required by law, provider policy, or infrastructure-security needs.
Upon termination, your access to cloud Services may stop, and account-related cloud data will be handled according to our Privacy Policy. You retain physical possession of any Device you own, subject to these Terms and applicable law. Data stored locally on the Device remains under your control unless you delete it, reset the Device, or transfer the Device.
Sections intended by their nature to survive termination will survive, including Sections 5, 8, 10, 11, 12, 13, 14, 17, and 18.
16. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will post the updated Terms on our website with a new "Last Updated" date and, where appropriate, provide additional notice.
Your continued use of the Services after updated Terms become effective means you accept the updated Terms. If you do not agree to updated Terms, you must stop using the Services.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
Any dispute arising out of or relating to these Terms, a Device, or the Services will be resolved exclusively in the state or federal courts located in San Francisco County, California, except where applicable law requires another forum. You and PamirAI consent to the personal jurisdiction and venue of those courts.
18. General Terms
Entire Agreement. These Terms, together with the Privacy Policy and any product-specific, checkout, or written policy terms referenced in them, form the entire agreement between you and PamirAI regarding the Services.
Severability. If any provision is found invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in effect.
No Waiver. PamirAI's failure to enforce a provision is not a waiver of its right to do so later.
Assignment. You may not assign or transfer these Terms without PamirAI's prior written consent. PamirAI may assign these Terms as part of a merger, acquisition, reorganization, sale of assets, operation of law, or otherwise.
Force Majeure. PamirAI is not liable for failure or delay caused by events beyond its reasonable control, including natural disasters, labor disruptions, supply-chain disruption, acts of government, war, terrorism, pandemics, power failures, internet outages, provider failures, or infrastructure incidents.
Notices. Notices to PamirAI should be sent to founders@pamir.ai. Notices to you may be sent to the email address associated with your account or through the Services.
